1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the Webracha platform (“Service”), operated by Shirisha Digital (“Webracha,” “we,” “us,” or “our”).
By registering for or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. We reserve the right to update these Terms at any time with notice to you.
2. Service Description
Webracha provides a software-as-a-service platform that enables property hosts to:
- Create and publish a branded property website with a custom domain (Professional/Enterprise plans).
- Accept direct guest bookings with integrated availability calendars.
- Process online payments via Cashfree Payments (our third-party payment gateway).
- Manage bookings, guest communications, and property listings from a hosted dashboard.
- Receive booking notifications via email and browser push.
Webracha provides the platform and infrastructure; the property host is solely responsible for the accuracy of their listings, pricing, and the quality of hospitality services provided.
3. Account Terms
- You must be at least 18 years old and legally capable of entering into contracts to use the Service.
- Each Starter plan account is for a single property. You may not use one Starter account to manage multiple properties.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate, current, and complete information during registration and keep it up to date.
- Hosts are solely responsible for all content they publish, including property descriptions, photos, pricing, policies, and availability.
4. Pricing, Billing & Payments
4.1 Subscription Plans
Webracha offers the following plans (prices in ₹, inclusive of applicable taxes):
- Starter: ₹1,999/month + ₹4,999 one-time setup fee
- Professional: ₹4,999/month + ₹9,999 one-time setup fee
- Enterprise: ₹9,999/month + ₹19,999 one-time setup fee (coming soon)
4.2 Setup Fee
A one-time setup fee is charged upon onboarding. This fee covers account configuration, property website setup, payment gateway integration, and go-live support. The setup fee is non-refundable once the onboarding process has commenced.
4.3 Monthly Subscription
Monthly subscriptions are billed in advance on a recurring basis from the date of activation. Subscriptions auto-renew each month unless cancelled before the renewal date.
You may cancel your subscription at any time. Cancellation stops future billing; however, no refund is provided for any partial month already billed. Your service will continue until the end of the current billing period.
4.4 Guest Payments
Guest booking payments are processed by Cashfree Payments and transferred directly to the Host’s linked bank account. Webracha does not hold or intermediate guest funds beyond facilitating the payment flow. Cashfree’s own fees and settlement timelines apply.
4.5 Pricing Changes
We reserve the right to change subscription pricing with at least 30 days’ notice via email. Price changes take effect at the start of your next billing cycle after notice.
5. Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
- Post false, misleading, or fraudulent property listings.
- Use the platform for any illegal activity, including money laundering or tax evasion.
- Impersonate any person or entity or misrepresent your affiliation with any entity.
- Upload content that infringes third-party intellectual property rights.
- Use automated tools to scrape, crawl, or extract data from the platform without our written consent.
- Interfere with or disrupt the integrity or performance of the platform or its infrastructure.
Violation of this acceptable use policy may result in immediate suspension or termination of your account without refund.
6. Intellectual Property
- Platform: Webracha and all its technology, design, features, software, and trademarks are owned by Shirisha Digital. You may not copy, reverse-engineer, resell, or sublicense any part of our platform.
- Your Content: You retain full ownership of all content you upload — property photos, descriptions, room data, and other materials. You grant Webracha a limited, non-exclusive licence to host, display, and transmit your content solely for the purpose of delivering the Service to you.
- Feedback: Any suggestions or feedback you provide about the Service may be used by us without obligation or compensation to you.
7. “Powered by Webracha” Badge
Properties on the Starter plan will display a small “Powered by Webracha” attribution badge in the footer of their guest-facing website. This badge links to webracha.com.
Properties on the Professional and Enterprise plans may remove this badge and have a fully white-labelled website footer.
You must not remove, obscure, or modify the Powered by Webracha badge on Starter plan websites.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Webracha shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Loss of revenue, bookings, or business opportunities due to platform downtime, errors, or delays.
- Actions or omissions of third-party providers (Cashfree, ZeptoMail, WorkOS, etc.).
- Disputes between Hosts and their Guests regarding property conditions, payments, or service quality.
Our total aggregate liability to you in any calendar year shall not exceed the total subscription fees paid by you to Webracha in that year.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
10. Termination
- By You: You may terminate your account at any time by contacting us at shirishadigital29@gmail.com. Cancellation stops future billing; no refund for the current period.
- By Us: We reserve the right to suspend or terminate your account with 30 days’ notice for any reason, or immediately if you violate these Terms, engage in fraudulent activity, or fail to pay outstanding fees.
- Data Export: Upon termination, you may request an export of your property data within 30 days. After that, data will be deleted pursuant to our Privacy Policy.
- Effect of Termination: Upon termination, your property website will be taken offline and guest-facing pages will no longer be accessible.
11. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law provisions.
Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts located in India.
